Agreement & Liability Waiver

In anticipation of participating in the activities involved in an Art-and-Wine painting party (hereinafter “Event”) organized by High Tide Art School, 64 Coburg, unit 1. Saint John NB

I hereby agree as follows:

In exchange for paying the specified amount, I will be allowed to participate in the Event, which is to take place at the designated time, date, and address listed in the event details. My right to participate in the Event is not transferable to any third party unless the Art-and-Wine painting party gives its written consent to such transfer and said the third party agrees to be bound by the terms of this agreement. My payment to the Art-and-Wine painting party is non-refundable. However, the Art-and-Wine painting party, in its sole discretion, chooses to provide a refund in cash or a gift certificate toward attending a future event.

The Event is a party in which other attendees and I will receive a painting lesson while being served snacks and/or drink. I understand that there are certain inherent risks associated with participating in the Event, including, but not limited to: paint stains and other damage to clothing and other personal property. I assume full responsibility for any harm, loss, or damage that may happen to me or to my property; and I release and discharge SIP Parties from any and all liability, of any sort whatsoever, whether caused by me, SIP Parties or their agents, or any third party.

I understand that a third party, unaffiliated with the Art-and-Wine painting party, will provide food and/or alcohol at the Event and that my fellow attendees may consume varying amounts of alcohol. I declare that I am of legal age to consume alcohol. I agree to limit my consumption of alcohol to a safe and reasonable level (including, if I so choose, none at all), and I shall make provisions for transportation to and from the event, as necessary. I am solely responsible for managing my own allergies, especially food allergies.

I agree to follow the directions and instructions of the Art-and-Wine painting party and its agents. I agree to use reasonable prudence, caution, and common sense at all times during the event, as well as in my coming and going. I understand that the Art-and-Wine painting party, in its sole discretion, may have me removed from the Event, and that, in that case, I shall not be entitled to a refund or to any other damages or reimbursement. I shall indemnify and hold harmless Art-and-Wine painting party against all claims and causes of action that may arise based on my conduct at the event, as well as in my coming and going, whether that conduct consists of negligence, recklessness, intentional acts, or otherwise.

I have read the following Liability Waiver and agree to be bound by its terms. By checking the corresponding box, I forfeit my right to bring a lawsuit against Art-and-Wine painting party. In return, I will be permitted to participate in the Event. This waiver shall be binding on me and on my heirs, executors, administrators, successors, and assigns. If for any reason some part of this waiver is held to be unenforceable, then the rest of this waiver and all of its remaining terms shall nevertheless remain in full force. This waiver shall be governed by, and construed according to, the laws of the Province of New Brunswick ( Canada), without regard to conflicts of laws principles.
